These terms govern the use of PocketGPT. By creating an account, installing the service on a device or just using the website, you confirm that you have read them and agree to them. If you do not agree, please do not use the service.
1. What PocketGPT is
PocketGPT is a web service that lets you, while reading on an e-book device, pass a highlighted quote, the book title and the author’s name to a lightweight page and ask the AI a question. The service can be installed on devices (currently Kobo; other readers subject to support) automatically or manually.
2. Account
- You provide truthful information and are responsible for keeping access to your account.
- All actions taken with your account are considered the user’s actions.
- You must be a legally capable person and at least 16 years old.
- Do not hand your account over to third parties and do not publish sign-in links.
3. Subscription
The subscription is issued as a voluntary monthly donation via Patreon. Payment, cancellation and refund terms are described in the refund policy and in Patreon’s rules. A free promo code has no monetary value and cannot be sold or exchanged.
4. Installation on a device
Installing PocketGPT on a reader changes the device’s settings or files. You do it at your own discretion and at your own risk. You understand and agree that:
- all responsibility for the installation, its outcome and the device’s further operation lies with you;
- if something goes wrong — the device stops booting, works unstably, loses data or settings, the manufacturer’s warranty is voided or the firmware is damaged — we bear no liability whatsoever and do not compensate losses;
- before installing, you back up important data yourself and read the instructions carefully;
- you choose between automatic and manual installation yourself and verify that your model and firmware version meet the requirements;
- after a manufacturer firmware update the service may stop working, and we do not guarantee a quick fix.
We may give advice as best we can, but this is neither an obligation nor a guarantee of success.
5. User responsibility for actions
You are solely responsible for everything you do with the service and on your device, including:
- the content of your questions and quotes and its lawfulness;
- respecting authors’ rights to the books you quote from and the rules of their rights holders and stores;
- the consequences of using the answers you receive;
- compliance with the reader manufacturer’s terms and third-party services (Patreon, book providers);
- the settings, password and security of your account and device.
6. Acceptable use
It is prohibited:
- to use the service for unlawful actions, fraud or harm to others;
- to attempt to bypass restrictions, break in, overload or use the service en masse in an automated way;
- to resell access or provide it to others without our consent;
- to request unlawful, abusive or harmful content from the AI.
Violations may lead to account restrictions or blocking without refunding payments.
7. AI answers
The AI can be mistaken and provide incomplete or outdated information. Web search results are not our statements. Answers are informational and do not replace the advice of a doctor, lawyer, financial adviser or other professional. Verify important information yourself.
8. Intellectual property and your content
The website, its design and code belong to us or our licensors. You keep the rights to your quotes and questions and grant us a limited licence to process them solely to provide the service (see the privacy policy). The names PocketGPT, Kobo, KOReader, Patreon and others belong to their owners; we are not affiliated with nor endorsed by them.
9. Availability and changes to the service
The service is provided “as is”. We may change, restrict or discontinue individual features, including support for certain devices, and we do not guarantee uninterrupted, fault-free operation.
10. Disclaimer of warranties and limitation of liability
To the extent permitted by law, we give no warranties (including fitness for a particular purpose) and are not liable for direct or indirect losses, data loss, device damage, lost income or other consequences of using the service. If liability nevertheless arises, it is limited to the amount you paid for the service in the last month. These provisions do not limit rights that cannot be excluded by law.
11. Indemnification
You agree to indemnify us for losses caused by breaches of these terms or the law, as well as third-party claims related to your actions.
12. Termination
You may stop using the service and cancel the Patreon subscription at any time. We may suspend or close access in case of terms violations. Provisions on liability and limitations also apply after termination.
13. Governing law and disputes
These terms are governed by the laws of Ukraine, except where mandatory norms of your country require otherwise. First, we try to resolve disputes by correspondence: [email protected].
14. Changes to these terms
We may update the terms. The revision date is at the top. Continued use after changes means your agreement with the new version.
